1. Acceptance of Terms

By accessing or using the JagoTest platform, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and JagoTest regarding your use of the Services. By registering for an account or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Services

JagoTest provides an online platform for exam preparation, practice tests, and educational content. Our Services include, but are not limited to:

• Access to practice exams and tryout packages
• Performance tracking and analytics
• Educational content and study materials
• User accounts to save progress and purchase packages

JagoTest reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the Services without notice or liability.

3. Eligibility

You must be at least 13 years of age to use the Services. If you are under 18 years of age, you must have the consent of a parent or legal guardian to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

Certain features of the Services, such as purchasing packages, may require you to be at least 18 years of age or have the consent of a parent or legal guardian who agrees to be bound by these Terms.

4. User Accounts

To access certain features of the Services, you must register for an account. When registering, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify JagoTest of any unauthorized use of your account or any other breach of security. JagoTest will not be liable for any loss or damage arising from your failure to comply with this section.

JagoTest reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms.

5. Payments and Subscriptions

Certain features of the Services may require payment of fees. You agree to pay all fees and charges associated with your account on a timely basis and according to the fees, charges, and billing terms in effect at the time a fee or charge is due.

By providing a payment method, you authorize JagoTest to charge the applicable fees to that payment method. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms.

All fees are exclusive of taxes, which may be added to the fees charged to you at the time of purchase. You are responsible for paying any applicable taxes.

Refunds may be available in accordance with our refund policy, which may be updated from time to time. Generally, refunds are only available within 7 days of purchase and only if the purchased package has not been accessed.

6. Content and Intellectual Property

All content on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of JagoTest or its content suppliers and is protected by international copyright laws.

JagoTest grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. You may not:

• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services
• Use the Services for any commercial purpose
• Modify, adapt, or hack the Services or modify another website to falsely imply that it is associated with JagoTest
• Use any automated system, including but not limited to "robots," "spiders," or "offline readers," to access the Services

Any feedback, comments, or suggestions you may provide regarding the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions without any obligation to you.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any laws, rules, or regulations
• Infringing the intellectual property rights of JagoTest or any third party
• Submitting false or misleading information
• Uploading or transmitting viruses or any other type of malicious code
• Interfering with or disrupting the integrity or performance of the Services
• Attempting to gain unauthorized access to the Services or related systems or networks
• Impersonating another person or entity
• Sharing account credentials with third parties
• Using the Services for any illegal or unauthorized purpose

JagoTest reserves the right to investigate and take appropriate legal action against anyone who, in JagoTest's sole discretion, violates this provision.

8. Termination

JagoTest may terminate or suspend your access to all or part of the Services, without notice, for any conduct that JagoTest, in its sole discretion, believes is in violation of these Terms, is harmful to other users, or is harmful to JagoTest's business interests.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

JAGOSOAL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

JAGOSOAL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JAGOSOAL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL JAGOSOAL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO JAGOSOAL FOR THE SERVICES DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Changes to Terms

JagoTest reserves the right to modify these Terms at any time. We will provide notice of significant changes to these Terms by posting the new Terms on the Services and updating the "Last Updated" date at the top of these Terms.

Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Services.

It is your responsibility to review these Terms periodically for changes. If you do not agree to any of the changes to these Terms, you must stop using the Services.
